Can Bankruptcy Discharge Student Loans in Illinois?
Generally no — student loans in Illinois require proving "undue hardship" via the Brunner test (or Totality test in some circuits). Requires adversary proceeding under 11 U.S.C. § 523(a)(8). Success rates are low but improving after 2022 DOJ guidance. Private loans without educational-loan status are more readily dischargeable.
